Qualifications and Disqualifications to Stand for Resident Board Director 

 


 

Qualifications



In accordance with its commitment to maintaining the highest standards of probity, the Board expects any resident board director to comply with his/her tenancy or lease terms.

The eligibility criteria are as follows:

  • 18 years or over
  • A secure tenant (sole or joint tenant) on a regeneration estate or a leaseholder of Barnet Council,
  • Agree with the aims of Barnet Homes 
  • Be willing and able to attend meetings and attend training sessions
  • Not be employed by Barnet Homes
  • You may be employed by Barnet Council, but a maximum of 7 local authority councillors or council employees can be on the Board  
  • Have no caution or convictions for fraud, theft, deception or harassment
  • Have no rent or service charge arrears of more than 2 months (or such that possession
  • proceedings/legal proceedings could be commenced by Barnet Homes)
  • Not previously have been evicted for breach of tenancy within the last 5 years.

Tenant and leaseholder board directors must also continue to reside within the geographical area from which they were elected. 


 

Disqualifications


 

Directors can be disqualified if they are in serious breach of their tenancy or lease terms.

This covers unpaid rent arrears, breaches of tenancy, unpaid service charges, breaches of lease. They can also be disqualified if they:

  • Cease to be a secure tenant or move to another geographical area within Barnet Homes
  • Become bankrupt or make any arrangement or composition with your creditors.
  • Become prohibited by law from being a Director of a company.
  • Are convicted of any criminal act or omission unless the Board determines otherwise.
  • Are the subject of a custodial sentence imposed by a court in the United Kingdom in respect of any criminal actor omission unless the Board determines otherwise.
  •  Become incapable, by reason of mental disorder, illness or injury of managing and administering your property and affairs.
  • Resign from office by giving written notice to Barnet Homes.
  • Are removed by a resolution of the directors.
  • Following failure to follow the code of conduct of Barnet Homes
  • Any director who has previously been the subject of board disciplinary proceedings which have resulted in their being recommended for removal from the board will be disqualified from standing for office again unless the board votes in favour of them standing again.
